The use of these systems carries significant responsibility and a baseline requirement of technical competence.
This section affirms that customers are expected to understand the essential principles of power, fuel, water, and mechanical operation relevant to their purchase. It also asserts that Invictus Ark will not provide compensation, refund, or warranty coverage for damage caused by a customer's lack of understanding.
I. THE CUSTOMER’S DUTY TO OPERATE PRODUCTS PROPERLY
Upon purchasing from Invictus Ark, the customer assumes responsibility for ensuring that their usage of our products complies with proper procedure and reflects a basic level of mechanical, electrical, and fuel-handling knowledge.
This duty includes:

Reading all included manuals and instructional materials before first use

Reviewing technical specifications provided on the product’s webpage

Ensuring compatibility with existing equipment and power loads

Understanding limitations of wattage, amperage, voltage, and resistance

Applying correct fuel and lubricant ratios (where applicable)

Using adequate ventilation for fuel-based systems

Storing all equipment in climate-appropriate and secure environments

Using electrical grounding where indicated

Operating within defined environmental limits (temperature, humidity, elevation)
A warranty will not be honored if it is determined that the customer failed to uphold these basic usage responsibilities.
II. ELECTRICAL SYSTEM KNOWLEDGE EXPECTATIONS
Electricity is not inherently user-friendly. Any customer purchasing backup power systems, inverter kits, or solar-battery products from Invictus Ark is expected to understand the following prior to setup or usage:

Voltage Matching: Products must be used with voltage-matched devices. Overvoltage will damage internal components. Undervoltage can cause systems to fail to activate.

Amperage Awareness: Plugging a high-amperage appliance into a low-output device can cause the unit to overheat, shut down, or suffer irreversible damage.

Polarity and Polarity Reversal: Reversing the positive and negative terminals on solar input, DC connections, or battery expansion cables may cause instant damage.

Overload Conditions: The cumulative wattage draw must never exceed the continuous output rating of a battery or inverter. Start-up surges must be considered when powering motor-driven appliances.

III. FUEL SYSTEM KNOWLEDGE EXPECTATIONS
For any generator, pump, or liquid-fuel system sold by Invictus Ark, the customer is responsible for:

Understanding storage requirements (metal containers, away from sunlight, ventilation)

Knowing how to prime a pump, bleed a line, or open a shutoff valve correctly

Using the correct fuel-oil mix, if required

Avoiding storage of fuel inside residential buildings

Ensuring carbon monoxide ventilation during use

Using spark arrestors when required by local law or label

Not operating fuel systems near flames, heat sources, or compressed oxygen cylinders
If a system fails due to:

Contaminated fuel

Improper fuel type

Running with no fuel

Clogged or burnt carburetor

Internal explosion from poor venting

Spark plug damage due to fuel flooding

Ethanol corrosion inside tank or line
…the failure will be deemed user-caused, and the warranty will be denied.
IV. EXPLICIT DISCLAIMER FOR CUSTOMER IGNORANCE
The following legal clause applies to every customer upon completion of a sale:
“The customer acknowledges that they are responsible for understanding the safe, legal, and operational use of the product(s) they purchase from Invictus Ark. VI. THE BURDEN OF KNOWLEDGE IS NON-TRANSFERABLE
In legal terms, the burden of knowledge rests with the user. Invictus Ark does not, and cannot, assume responsibility for a customer’s technical literacy, mechanical aptitude, or home electrical architecture.
If the customer chooses not to read documentation, ignores safety labels, or “guesses” at how to connect a device, they are choosing to accept all consequences of that ignorance. In such cases, we owe no warranty, no refund, and no replacement.
PART V: LEGAL DISCLAIMERS, LIMITATION OF LIABILITY, ARBITRATION AGREEMENT, AND CLOSING STATEMENT
The purpose of this final section is to codify the legal boundaries that govern Invictus Ark’s warranty obligations. While we aim to provide strong post-purchase support, we also operate under binding legal constraints that define what we are not responsible for. This protects both the company and its stakeholders from being held accountable for unforeseeable or unreasonable claims.
I. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Invictus Ark shall not be held liable for any indirect, incidental, punitive, or consequential damages arising from the use or misuse of its products, even if Invictus Ark has been advised of the possibility of such damages. This includes, but is not limited to:

Invictus Ark’s total liability under any cause of action—whether in contract, tort, warranty, or otherwise—shall never exceed the original purchase price of the product in question.
By completing a transaction, the customer accepts that Invictus Ark does not insure or compensate for user ignorance, infrastructure faults, natural disasters, or third-party damages.
II. NO IMPLIED WARRANTIES BEYOND THIS POLICY
Unless otherwise stated in writing, Invictus Ark makes no other warranties, express or implied, other than those explicitly outlined in this policy. This includes but is not limited to:

No implied warranty of merchantability: We do not guarantee that any product will suit all customers' personal preferences.

No implied warranty of fitness for a particular purpose: It is the customer’s responsibility to ensure that a product meets their needs before purchase.

No implied warranty of uninterrupted functionality: Blackout survival tools inherently depend on weather, environmental conditions, and maintenance. We do not guarantee consistent uptime or off-grid performance.

No warranty of third-party compatibility: We are not liable if our systems are incompatible with unapproved batteries, adapters, appliances, or software.
All implied warranties are explicitly disclaimed under applicable U.S. law to the extent allowed.
III. MANDATORY BINDING ARBITRATION AGREEMENT
All warranty-related disputes must be resolved through binding arbitration, not litigation. By purchasing from Invictus Ark, the customer agrees to submit any disputes, disagreements, or claims arising out of this warranty policy to binding arbitration under the jurisdiction of San Bernardino County, California, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA).
This arbitration process:

This warranty policy, and all related disputes or interpretations, shall be governed and enforced under the laws of the State of California, United States, without regard to conflicts of law. The venue for any legal filing not subject to arbitration (e.g., small claims exceptions) shall be located in San Bernardino County.
Customers residing outside of the United States agree that this policy is enforceable regardless of international jurisdiction, and waive any attempt to override or nullify U.S. warranty law.
V. FORCE MAJEURE CLAUSE
Invictus Ark shall not be held liable for any delays, inability to fulfill warranty claims, or disruption of support services resulting from events beyond our control, including:

Government restrictions, import bans, or customs blockages

Pandemic-related labor or material shortages

Acts of terrorism, war, or sabotage

VI. SEVERABILITY AND MODIFICATION
If any part of this policy is found to be unenforceable or illegal by a court of competent jurisdiction, the remaining sections shall remain in full force and effect. Invictus Ark reserves the right to update this warranty policy at any time without notice, provided such changes do not affect the terms of warranties already in force at the time of purchase.
Customers are encouraged to periodically review this policy for changes. Continued use of Invictus Ark products and services constitutes acceptance of the most recent version.
VII. CLOSING STATEMENT: ETHICS OF PREPAREDNESS

At Invictus Ark, we do not sell products for casual or decorative use. We sell products meant to endure blackouts, overcome disaster, and help families regain control when infrastructure fails.
