If the customer chooses not to read documentation, ignores safety labels, or “guesses” at how to connect a device, they are choosing to accept all consequences of that ignorance. In such cases, we owe no warranty, no refund, and no replacement.

The purpose of this final section is to codify the legal boundaries that govern Invictus Ark’s warranty obligations. While we aim to provide strong post-purchase support, we also operate under binding legal constraints that define what we are not responsible for. I. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Invictus Ark shall not be held liable for any indirect, incidental, punitive, or consequential damages arising from the use or misuse of its products, even if Invictus Ark has been advised of the possibility of such damages. This includes, but is not limited to:

  • Electrical fires, shorts, or damage to third-party electronics

  • Fuel leaks, vapor ignition, or property damage from improper storage or installation

  • Injury, illness, or death caused by failure to ventilate or ground systems properly

  • Loss of data, revenue, or time resulting from device failure during an emergency

  • Structural or home damage from self-installed panels, batteries, or generators

  • Generator overuse resulting in fire, carbon monoxide poisoning, or explosion

  • System failure due to grid surge, lightning, or blackouts beyond our control

Invictus Ark’s total liability under any cause of action—whether in contract, tort, warranty, or otherwise—shall never exceed the original purchase price of the product in question.

By completing a transaction, the customer accepts that Invictus Ark does not insure or compensate for user ignorance, infrastructure faults, natural disasters, or third-party damages.


II. NO IMPLIED WARRANTIES BEYOND THIS POLICY

Unless otherwise stated in writing, Invictus Ark makes no other warranties, express or implied, other than those explicitly outlined in this policy. This includes but is not limited to:

  • No implied warranty of merchantability: We do not guarantee that any product will suit all customers' personal preferences.

  • No implied warranty of fitness for a particular purpose: It is the customer’s responsibility to ensure that a product meets their needs before purchase.

  • No implied warranty of uninterrupted functionality: Blackout survival tools inherently depend on weather, environmental conditions, and maintenance. We do not guarantee consistent uptime or off-grid performance.

  • No warranty of third-party compatibility: We are not liable if our systems are incompatible with unapproved batteries, adapters, appliances, or software.

All implied warranties are explicitly disclaimed under applicable U.S. law to the extent allowed.


III. MANDATORY BINDING ARBITRATION AGREEMENT

All warranty-related disputes must be resolved through binding arbitration, not litigation. By purchasing from Invictus Ark, the customer agrees to submit any disputes, disagreements, or claims arising out of this warranty policy to binding arbitration under the jurisdiction of San Bernardino County, California, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA).

This arbitration process:

  • Shall be conducted in English

  • Shall include a neutral third-party arbitrator mutually agreed upon

  • Shall allow for discovery, document submission, and evidentiary hearings

  • Shall not permit class action or collective relief claims

Each party will bear their own legal fees. The decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction.

This clause does not waive rights under the Magnuson-Moss Warranty Act but defines how disputes must be resolved.


IV. GOVERNING LAW AND VENUE

This warranty policy, and all related disputes or interpretations, shall be governed and enforced under the laws of the State of California, United States, without regard to conflicts of law. The venue for any legal filing not subject to arbitration (e.g., small claims exceptions) shall be located in San Bernardino County.

Customers residing outside of the United States agree that this policy is enforceable regardless of international jurisdiction, and waive any attempt to override or nullify U.S. warranty law.


V. FORCE MAJEURE CLAUSE

Invictus Ark shall not be held liable for any delays, inability to fulfill warranty claims, or disruption of support services resulting from events beyond our control, including:

  • Natural disasters (wildfire, earthquake, hurricane, flood)

  • Government restrictions, import bans, or customs blockages

  • Pandemic-related labor or material shortages

  • Acts of terrorism, war, or sabotage

  • Power grid failure, telecom collapse, or cyberattacks

In the event of such conditions, we will make commercially reasonable efforts to fulfill our obligations, but claims may be delayed or suspended without liability.


VI. SEVERABILITY AND MODIFICATION

If any part of this policy is found to be unenforceable or illegal by a court of competent jurisdiction, the remaining sections shall remain in full force and effect. Invictus Ark reserves the right to update this warranty policy at any time without notice, provided such changes do not affect the terms of warranties already in force at the time of purchase.

Customers are encouraged to periodically review this policy for changes. Continued use of Invictus Ark products and services constitutes acceptance of the most recent version.
